This legal process is often complex. When someone dies leaving possessions or property worth £5000 or more, legal processes known as Probate and Estate Administration must be carried out and are required regardless of whether there is a Will or not. In Scotland* this process is known as Confirmation.
why is the legal process so important?
Unless everything is handled properly, any property or posessions held in the sole same of the deceased cannot be released to the beneficiaries. The Government also requires tax forms to be completed and those dealing with the affairs are liable for any errors.
